Writs of Habeas Corpus for Nonviolent 3rd Strikers
Two recent superior court decisions in California, Edwards and Grinker, overturned California Department of Corrections and Rehabilitation (CDCR) rules that barred nonviolent third strikers from seeking relief under Proposition 57. This means the 3,000+ third strikers who have been denied parole hearings since Prop 57 passed in 2016 are now eligible. Specifically, the Edwards case repealed the portion of section 3491, subdivision (b)(1) of title 15 of the California Code of Regulations that allowed CDCR to keep third strikers locked up with no possibility of parole far beyond the base term for their offenses. This section also applied to 2nd strikers (it specifically changes rules about indeterminate/alternative sentencing).
In the Edwards case, the court instructed a hearing within 60 days of the decision. The Grinker case, which referred to Edwards in its decision, expedited that and required a hearing within just 5 days! We can’t guarantee this expedited process will happen for you or your loved one, but the case law is clear: nonviolent 3rd strikers are now eligible for early parole.
